This End User License Agreement ("Agreement") is between you and Clamshell Korlátolt Felelõsségű Társaság (Clamshell Kft.), registered seat 1021 Budapest, Völgy utca 27/B B. ép. I. em. 4. ajtó, Hungary ("we", "us"), the licensor of the Clamshell application ("the App"). By clicking Accept, you agree to these terms. If you do not agree, click Quit; you may not use the App.
1. License
You receive a personal, non-exclusive, non-transferable license to use this copy of the App on Apple Silicon Mac computers covered by your active Setapp subscription, for as long as that subscription remains active and the App remains available through Setapp. The App is licensed, not sold.
2. Setapp
This edition of the App is distributed exclusively through Setapp, operated by MacPaw Way Ltd. Your subscription, payment, refunds, and app updates are handled by Setapp under Setapp's own Terms of Use and refund policy. We do not sell licenses, collect payment, or process refunds for this edition directly.
3. What the App does and assumption of risk
The App keeps your Mac awake while the lid is closed by setting a system power-management state. When disarmed or quit, it attempts to restore normal behavior and warns you if the restore does not complete; restarting the Mac resets the state. Running a Mac with the lid closed in a bag, case, or other enclosed or poorly ventilated space can cause heat buildup, battery drain, and, in extreme cases, damage to your hardware. Do not run the App with the lid closed in a bag, case, or other enclosed or poorly ventilated space. You acknowledge and accept these risks, and you are responsible for using the App only in conditions that are safe for your hardware.
4. Restrictions
You may not reverse engineer, decompile, modify, rent, lease, resell, or redistribute the App except where applicable law expressly permits it despite this restriction.
5. Intellectual property
The App, including its design, code, and artwork, remains our property. This Agreement grants you no rights other than the license in section 1.
6. No warranty
The App is provided "as is", without warranty of any kind, to the maximum extent permitted by law. We do not warrant that the App will be error-free or uninterrupted, or that it is fit for any particular purpose. Nothing in this section excludes or limits the mandatory rights you have as a consumer under applicable law, including any statutory right to content that conforms to the contract, which cannot be waived.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the use of the App, including data loss, battery wear, or thermal effects of running a Mac with the lid closed. To the maximum extent permitted by law, we are also not liable for direct loss of or physical damage to your hardware, including overheating or battery damage, caused by running the Mac with the lid closed, the risk of which you accept under section 3. Where our liability cannot be excluded but may be limited, our total aggregate liability to you for all claims is limited to fifty euros (EUR 50). Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law, including liability for damage caused intentionally or by gross negligence, liability for death or personal injury, or your mandatory rights as a consumer.
8. Termination
This license ends automatically if you breach this Agreement, when your Setapp subscription lapses, or when you uninstall the App. Sections 4 through 9 survive termination.
9. Governing law
This Agreement is governed by the laws of Hungary. Mandatory consumer protections of your country of residence remain unaffected.
